GENOMICS SERVICES ADDENDUM

Functional Medicine & Educational Genomics Telehealth (California + Texas Licensed Provider)

This Genomics Services Addendum (“Addendum”) is part of the binding agreement between you and Provider and is governed by and subject to the Terms of Use, including arbitration, class action waiver, and jury trial waiver.

 

1. PURPOSE AND NATURE OF GENOMICS SERVICES
  Genomics services are provided within a functional medicine and educational framework. Genomics services may include:

  • review and interpretation of genetic test results (clinical or consumer)
  • education about genetic variants and biological pathways
  • discussion of gene–environment interactions
  • discussion of lifestyle, nutrition, and environmental considerations informed by genomic data
  • functional wellness insights are intended to support education and self-awareness
  • Genomics services are interpretive and educational and should be understood as guidance to support informed conversations with your licensed healthcare providers.


2. JURISDICTIONAL APPLICABILITY (CALIFORNIA + TEXAS)
  Genomics services are provided only to individuals physically located in the State of California  or the State of Texas, and are

delivered solely to the extent permitted by applicable state law and Provider’s licensure at the time services are rendered. If you are not physically located in California or Texas at the time of service, genomics services will not be provided.
You are responsible for accurately disclosing your physical location at the time of any genomics-related telehealth service.


3. NO MEDICAL DIAGNOSIS OR TREATMENT

Genomics services:

  • do not diagnose disease
  • do not treat disease
  • do not provide emergency care
  • do not prescribe medications
  • do not replace medical care from a physician or other qualified provider
  • Genetic findings and interpretations are probabilistic and should not be interpreted as definitive medical conclusions.


4. NOT GENETIC COUNSELING

Unless explicitly stated in writing and legally authorized, genomics services provided by Provider do not  constitute genetic counseling.

If genetic counseling or clinical genetics services are needed, you are responsible for seeking care from a licensed genetic counselor or qualified medical professional.


5. LIMITATIONS OF GENETIC TESTING AND INTERPRETATION

You acknowledge that:

  • genetic testing technologies have limitations
  • not all variants are clinically actionable
  • results can vary by lab methodology and reporting standards
  • scientific understanding of genomics evolves over time
  • interpretations may change as new evidence emerges
  • No guarantees are made regarding:
  • accuracy or completeness of third-party data
  • clinical significance of any variant
  • predictive value of results
  • future applicability of interpretations


6. DATA SOURCE AND THIRD-PARTY TESTING COMPANIES

Genomics services may rely on data obtained from:

  • third-party laboratories
  • direct-to-consumer genetic testing companies
  • raw data files you provide
  • Provider does not control and is not responsible for:
  • third-party lab accuracy, methods, or reporting
  • third-party privacy practices
  • data integrity once in third-party systems
  • You are responsible for reviewing and accepting third-party policies independently.


7. FUNCTIONAL MEDICINE CONTEXT (NO OUTCOME PROMISES)

Genomics insights are discussed within a functional wellness context that may include:

• nutrition

  • lifestyle patterns
  • environment and stress considerations
  • general systems-based education
  • No outcomes are guaranteed. Your results depend on numerous factors outside the Provider’s control.


8. INFORMED CONSENT FOR GENOMICS SERVICES

 

You acknowledge the potential:

Benefits

  • improved understanding of genetic tendencies
  • education on gene–environment interactions
  • personalized lifestyle and nutritional considerations (educational)
  • Risks and Limitations
  • misunderstanding or overinterpretation of genetic information
  • emotional discomfort or anxiety
  • inappropriate self-treatment without medical guidance
  • You agree to seek appropriate medical care for diagnosis or treatment decisions.


9. PRIVACY AND SENSITIVE INFORMATION

Genetic information is sensitive. Provider uses reasonable safeguards consistent with applicable privacy laws, but no system is perfectly secure.

You acknowledge inherent risks in electronic storage and communication of sensitive information.


10. NO GUARANTEES OR WARRANTIES

Provider makes no guarantees that genomics services will:

  • prevent disease
  • reduce risk
  • improve outcomes
  • optimize performance
  • Genomics services provide only educational and interpretive perspectives.


11. ASSUMPTION OF RISK

You voluntarily assume all risks arising from:

  • use of third-party genetic data
  • interpretation of genetic results
  • decisions you make based on the information provided


12. RELATIONSHIP TO DOCTOR–PATIENT STATUS

This Addendum does not, by itself, establish a doctor–patient relationship. Relationship formation occurs only as defined in the Terms of Use and after Provider’s affirmative acceptance.


13. GOVERNING TERMS AND DISPUTES

This Addendum is governed by and subject to the Terms of Use, including binding arbitration, class action waiver, and jury trial waiver.

     

14. ACKNOWLEDGMENT

By proceeding with genomics services, you acknowledge that you have read, understood, and agreed to this Addendum.
